To help you stay compliant with the General Product Safety Regulation (GPSR), effective December 13, 2024, here’s a guide on what you need to know.
These rules ensure that products available to EU consumers meet high safety standards and include requirements for handling product safety information, notifications, and recalls.
If you sell to consumers, you must meet the below criteria.
1. Single Point of Contact
- You should have a designated contact person for direct communication with EU authorities and consumers concerning product safety issues. This person should be easily reachable by email and other electronic means.
- Registration: You must register this contact with the Safety Gate Portal, the EU’s notification system for dangerous products.
2. Internal Compliance Processes
- Establish internal processes that ensure all products comply with GPSR safety standards, including a system for self-certifying that products meet GPSR guidelines.
- Additional Requirements: You may need to gather traceability information about the traders.
3. Prompt Handling of Safety Orders
- You must have systems in place to promptly respond to orders from EU authorities requiring actions like removing dangerous product listings, disabling access to them, or displaying safety warnings.
- Timing: These actions should be completed within two working days, with updates sent to authorities via the Safety Gate Portal.
4. Staying Informed on Product Safety Notifications
- You should actively monitor the Safety Gate Portal for alerts on dangerous products. If notified, you must inform the authority of any actions taken and stay in contact with the relevant market surveillance authorities.
5. Processing Product Safety Notifications (as per DSA)
- If notified by any person or authority about potentially unsafe content or products, you must act quickly. You should address notifications without delay and within three working days of receiving them.
6. Clear Product Information Display
- Each product listing should include easily accessible information such as:
- The manufacturer’s name and contact details
- Product identification information (e.g., EAN, product type)
- Safety warnings, if applicable, displayed in the language of the EU Member State.
7. Suspending Non-Compliant Sellers
- You should suspend services to sellers who frequently offer products that do not meet safety or compliance standards. By buying via Qogita you can be sure that all our sellers are compliant.
8. Collaboration with Authorities on Product Recalls and Safety
- You are responsible for supporting safety investigations, recalls, and other corrective measures. Key actions include:
- Notifying consumers: If a product you bought is recalled or flagged for safety concerns.
- Alerting traders: About any product content removals or safety updates.
- Keeping authorities informed: Through the Safety Business Gateway, notifying them of any dangerous product listings or safety actions taken.
- Accident Reporting: You must report accidents or issues causing consumer harm if a product from your platform is involved and notify both the manufacturer and authorities.
9. Additional Support for Surveillance Authorities
- You should assist EU authorities by:
- Allowing safe access to your product safety data tools
- Cooperating in tracking dangerous product supply chains
- Granting data access for product safety upon official requests
